Convicted ‘kingpin’ remanded without bail

NORWICH – Michael A. Victor Jr, who was found guilty in Chenango County Court in 2010 on ten counts including narcotic sales and firearms possession, appeared in court on Thursday after being granted a retrial.

As decided by the Appellate Division of the Supreme Court of New York on May 5, 2016, one of the ten counts was dismissed, and Victor is to receive a new trial on the remaining nine counts that he faced after his initial arrest in 2010. Victor is serving a 39 year sentence.

Victor appeared with his assigned attorney Mr. Grace, and First Assistant District Attorney Michael Ferrarese was present on behalf of the people. Judge James E. Downey presided.

Ferrarese asked that the court grant an adjournment, as the people are awaiting to hear back from the Court of Appeals.

Chenango County District Attorney Joseph McBride was contacted for comment regarding this decision when it was handed down in May.

“I am disappointed in the Appellate Division’s decision,” McBride said. “The reason for the reversal does not appear in any reason to have adversely affected the defendant’s right to a fair trial.”

McBride said, “We are asking the Court of Appeals to review the Appellate Division’s decision to revisit the legal issue of Mode of Proceedings Errors.”

On Victor’s behalf, Grace said, “My client would like an offer from the District Attorney’s Office today, or a trial tomorrow.”

Downey said that since Grace has not received all discovery materials from Victor’s previous attorney, the DA’s office shall provide the discovery to him.
