NORWICH – Within the last week in Chenango County Court, two co-defendants in the December 2015 Division Street methamphetamine bust appeared in court to be arraigned on their charges.
Judge Frank B. Revoir Jr. presided over both cases, while First Assistant District Attorney Michael D. Ferrarese was present on behalf of the people.
It is alleged per a press release that on Monday Dec. 21, 2015, at approximately 9:17 p.m., the Norwich Police Department received a ‘Loud Noise’ complaint from a residence on Division Street.
Allegedly the residents at this residence on 39 Division Street were outside yelling and swearing at each other, when officers responded to the residence and made contact with several individuals.
While investigating the complaint, officers were said to have observed what they believed to be a ‘One-Pot’ methamphetamine cooking container in plain view, as well as numerous precursors for the production of methamphetamine.
The Norwich Police requested the assistance of the New York State Police – CCERT (Contaminated Crime Scene Emergency Response Team).
The NPD and NYSP CCERT were on the scene for several hours while the chemicals, containers and evidence were collected.
The Norwich Police Department arrested three individuals from this incident.
Freeman J. Deabay III, 44, of Division Street in Norwich, and Stephanie Vierkant, 34, of Division Street in Norwich were both charged with unlawful manufacturing of methamphetamine, a class D felony; criminal possession of a controlled substance in the seventh degree, a class A misdemeanor; endangering the welfare of a child, a class A misdemeanor; and criminal nuisance in the second degree, a class B misdemeanor.
The third individual, Kyah M. Stein, 37, of Sherman Road in Oxford was charged with loitering in the first degree, a class B misdemeanor.
Deabay and Vierkant were arraigned in Norwich City Court and remanded to the Chenango County Correctional Facility on $10,000 bail. Stein was released on an appearance ticket and is to reappear in Norwich City Court at a later date.
Due to a delay in the criminal evidence being processed, both Vierkant and Deabay were released on the 45-day rule.
In February of 2016, both Vierkant and Deabay were indicted by a Chenango County grand jury.
The grand jury indictment read, “it is alleged that on Dec. 21, 2015 in the City of Norwich on Division Street and while acting in concert with another individual, that (Vierkant and Deabay) allegedly did possess a 16 ounce plastic bottle with plastic tubing. This plastic bottle allegedly contained: hydriotic sulfuric acid, sodium hydroxide, ammonium nitrate and white gas, in order to unlawfully manufacture methamphetamine.”
The child endangering charges stem from the fact that two children were allegedly present in the house and were subjected to toxic chemicals from the manufacture of the methamphetamine. At the time of the arrest on Dec. 21, 2015 the children were four years old and nine months old.
• Vierkant was in Chenango County Court on Feb. 22, with her attorney Kayphet Mavady to be arraigned on the indictment charges.
Mavady did waive a reading of the indictment and entered not guilty pleas to all the charges.
“We ask for $15,000 cash bail and $20,000 bond be set your honor. She was released under the 45-day rule, due to the lab not getting back to us. She has a significant criminal history, mostly out of state, warrant, failure to appears and arrests,” said Ferrarese.
Ferrarese then named various arrest dates dating as far back as 2002 and as recent as 2013.
