Hate Crimes, Sex Crimes, And Drug Crimes Among August Indictments

NORWICH – A Chenango County grand jury met for the month of August and as a result saw 11 individuals indicted last week.

• Wayne J. Spratley, 33, of Greene, was indicted on six felony charges. Spratley was charged with attempted murder in the second degree as a hate crime, a class B felony; assault in the first degree as a hate crime, a class B felony; criminal use of a firearm in the first degree as a hate crime, a class B felony; attempted murder in the second degree, a class B felony; assault in the first degree, a class B felony; criminal use of a firearm in the first degree, a class B felony.

Spratley was said to be employed with the New York State Department of Corrections.

It is alleged that Spratley, on July 19, 2015, in the City of Norwich at approximately 3:28 a.m. in a parking lot on Lackawanna Avenue, did intentionally attempt to cause the death of an African American male by pointing and discharging a Glock Model 20, 10mm handgun into the victim’s left lower abdomen, who then required surgery.

It is also alleged that Spratley did shoot the victim based on his race and did use racial slurs against the victim, which were released – but are not suitable for print.

• John C Bolster Jr., 26, of Hancock, was indicted on two felony charges and one misdemeanor charge. Bolster was charged with the crime of rape in the second degree, a class D felony; criminal sexual act in the second degree, a class D felony; and endangering the welfare of a child, a class A misdemeanor.

It is alleged that Bolster, on a day in the month of July, 2014 on Midland Road in the Town of Afton, that Bolster being over the age of 18-years-old, did engage in sexual intercourse, oral sex, as well as knowingly act in a manor likely to cause injury physically, mentally, or morally to the welfare to the 15-year-old female victim.

• Donald J Mercer, 49, of Columbus, was indicted on four felony charges as well as one misdemeanor charge. Mercer was charged with rape in the third degree, a class E felony; three counts of criminal sexual act in the third degree, a Class E felony; and endangering the welfare of a child, a class A misdemeanor.

It is alleged that on County Road 41 in the Town of Columbus, that Mercer being over the age of 21-years-old, did engage in sexual intercourse in November 2013; oral sex in September 2013; anal sex in December 2013; and oral sex in January 2014; as well in September 2013 knowingly act in a manor likely to cause injury physically, mentally, or morally to the welfare of a child; doing so with a 17-year-old female victim.

• Jeffrey W White Jr., 27, of Afton, was indicted on one felony crime and one misdemeanor charge. White was charged with rape in the third degree, a class E felony; and endangering the welfare of a child, a class A misdemeanor.

It is alleged that White, on May 23, 2015 in the Whispering Pines trailer park in the Town of Afton, being over 21-years-old did unlawfully engage in sexual intercourse with a female 15-year-old female victim; as well as knowingly act in a manor likely to cause injury physically, mentally, or morally to the welfare of a child.

• John W Quinn, 26, of Sherburne, was indicted on five felony charges. Quinn was charged with criminal possession of a controlled substance in the second degree, a class A-11 felony; unlawful manufacture of a methamphetamine in the third degree, a class D felony; unlawful disposal of a methamphetamine, a class E felony; criminal possession of precursors to methamphetamine, a class E felony; and tampering with physical evidence, a class E felony.

It is alleged that Quinn, on July 13, 2015 in the Town of Sherburne on Kendrick Road, did knowingly and unlawfully possess a Mountain Dew bottle containing a liquid substance, which was methamphetamine, which had an approximate weight of three ounces. It is also alleged that at the same time and place, did knowingly and with intent to use, possessed sodium hydroxide, ammonium nitrate, lithium, coffee filters, a mason jar, pseudoephedrine, and a Mountain Dew bottle which are the precursors to unlawfully manufacture methamphetamine. Quinn is also charged with the disposal of the methamphetamine lab, as he allegedly threw a plastic bottle containing, hazardous materials, out the window of his vehicle, essentially tampering with the physical evidence while creating a substantial health risk to humans and the environment.

• Stephen A Reilly, 22, of Norwich, was indicted on two felony charges. Reilly was charged with criminal sale of a controlled substance in the third degree, a class B felony; and criminal sale of a controlled substance in the third fifth degree, a class D felony.
