NORWICH – Chenango County Court on Monday August 10, 2015 had a full schedule as it saw a total of 10 scheduled court cases, two of which were the heroin cases in Tuesday’s edition, with an unexpected add-on late in the day.
Judge Frank B. Revoir Jr. was the Judge present for all the matters on the day. While District Attorney Joseph A. McBride was present all day speaking on behalf of the people of Chenango County.
• Damion M. Spicer, 19, of Mitchell Street in Norwich appeared in court on charges related to a burglary incident which he was previously charged on.
Spicer was represented by his Attorney John Cameron.
Spicer appeared in court on the possibility of waiving his right to indictment.
Spicer was charged with burglary in the third degree a class D felony, grand larceny in the fourth degree a Class E felony, and petit larceny a class A misdemeanor.
Cameron at this time entered a plea of not guilty for all the charges.
McBride filed his affidavit at this time while saying, “Judge, the defendant was caught breaking into place stealing computers and other things while under the influence of alcohol, he is only 19 years old so I am not asking for any additional bail at this time. I would ask however that he not consume any drugs or alcohol anymore. I want to know if he is going to be a criminal or a citizen of this community.”
Spicer was released on his own recognizance but will be ordered to report to James Everard for drug and alcohol monitoring as the court imposed it.
• Daniel J. Astrolongo, 33, also appeared in Chenango County Court on charges related to a burglary.
Attorney Lindon Summers represented Astrolongo.
Astrolongo was charged with burglary in the second degree a class C felony, and petit larceny a class A misdemeanor.
At this time during court proceedings Summers entered a plea of not guilty to the above charges.
“Stealing computers and other objects, while having two prior felonies and additional arrests. With a history of substance abuse problem and a pending case in Broome County on misdemeanor charges. I ask for $50,000 bail at this time,” said McBride.
Original bail and bond were set at $5,000 and $10,000 by the local court.
At this time Revoir raised the bail to $25,000 per the District Attorney’s request due to a history of charges.
The pre-plea investigation process was set to begin at this time by the Court.
“Can we also get an order of protection on the victim,” said McBride.
An order of protection on the victim was issued at this time. Astrolongo was then handcuffed and remanded to the Chenango County Correctional Facility in lieu of the bail set.
• Ryanne R. Shepard, 26, appeared in court on charges stemming from welfare fraud, with her Attorney John Cameron.
She was previously charged with welfare fraud in the 3rd degree, a class D felony. It is alleged that on or during July 1, 2012 and March 31, 2013 she concealed her boyfriend’s income in order to receive public assistance in the amount of $7,500.
Shepard was sentenced to one year interim probation as well as being required to pay $5,000 of the $7,500 within the next calendar year, with minimum payments of $400 a month. Sheppard will also face three years probation after the interim probation is up and must submit a DNA sample, an additional $50 charge.
The court plea of guilty and right to appeal waiver was issued and signed.
Shepard is due back in Chenango County Court on this matter on June 27, 2016 at 1:30 p.m.
• Heather R. Smith, 31, also appeared on charges of welfare fraud with her attorney John Cameron.
Smith was summoned to court in regards to her potentially changing her previous plea of not guilty to a guilty plea.
