Eight indicted by grand jury in June

NORWICH – Eight individuals were indicted this week during a grand jury hearing at Chenango County Court on charges ranging from DWI to felony drug charges. An indictment from a grand jury is not a conviction, rather a decision to bring felony charges on an individual.

• Michael B. Mack, 25, Utica, was indicted on three separate charges, two of which involve narcotics. Indicted on criminal possession of a controlled substance in the third degree, a D felony, it was alleged that Mack knowingly possessed 3.5 grams of crack cocaine with intent to sell said crack cocaine. Mack was also indicted on the charges of criminal possession of a controlled substance in the seventh degree, a class A misdemeanor, when it was alleged that Mack was in possession of an amphetamine. The last charge Mack was indicted on was tampering with physical evidence, an E felony. It was alleged that Mack gave physical evidence to a co-defendant with the intent to conceal the object.

• A 16 year old youth from Sherburne, was indicted on one charge of rape in the first degree, a class B felony. It is alleged that the youth raped a 13 year old victim. The youth was also indicted on endangering the welfare of a child, an A misdemeanor, as a result of the aforementioned charges.

• Richard C. Swanson, 51, Oxford, was indicted on four separate charges, the most notable being vehicular assault in the second degree, a class D felony. Swanson allegedly caused serious physical injury when he operated a motor vehicle in violation of New York State traffic laws when his vehicle caused a collision with another motorist causing fractures to the victim’s right femur and right hip. During this it was alleged that Swanson was impaired by a drug or alcohol. As a result of the accident, Swanson was indicted on assault in the second degree, a D felony, as it was alleged that he recklessly caused serious physical injury when he recklessly drove his vehicle in front of another vehicle. Swanson was also indicted on charges of reckless endangerment in the second degree, an A misdemeanor, and driving while intoxicated, an A misdemeanor, all stemming from the alleged accident.

• Donald P. Scott, 51, Afton, was indicted on the charge of unlawful manufacturing of methamphetamines in the third degree, a class D felony. It is alleged that Scott knowingly, with intent to use, possessed lab equipment to produce methamphetamines.
