Chenango County Grand Jury Indicts Ten

NORWICH – The Chenango County grand jury handed up a number of criminal indictments on Wednesday. At a grand jury proceeding, the Chenango County District Attorney’s Office presents evidence against those they wish to prosecute. It is up to the jury to decide if there is enough reasonable cause to charge a person with a felony offense.

Those indicted by the grand jury are arraigned before the county or Supreme Court judge at a later date.

The grand jury indicted ten individuals:

• Scott G. Frost, 28, Binghamton, indicted for first degree robbery, a class B felony; third degree robbery, a class D felony; fourth degree criminal possession of a weapon; and petit larceny, both class A misdemeanors.

Allegedly Frost, in concert with another, “threatened the immediate use of a dangerous instrument,” by reputedly holding a folding knife to the back of an Extra Mart Convenience Store clerk while requesting she empty the contents of the cash register. Frost and his accomplice allegedly left the Extra Mart with $283, 18 packs of cigarettes and seven Win for Life lottery tickets.

• Arianna M. Michalski, 22, Binghamton, indicted for first degree robbery, a class B felony; third degree robbery, a class D felony; and petit larceny, a class A misdemeanor.

Allegedly Michalski, while acting in concert with another, threatened an Extra Mart Convenience Store clerk with a folding knife while demanding the contents of the store’s cash register. Michalski and her accomplice allegedly left the Extra Mart thereafter with $283, 18 packs of cigarettes, and seven Win for Life lottery tickets.

• Edward J. Dougher, 49, Binghamton, indicted for second degree criminal possession of a weapon, a class C felony; second degree criminal use of a firearm, a class C violent felony; tampering with physical evidence, a class E felony; and making a punishable false written statement, a class A misdemeanor.

It’s alleged that Dougher, on May 26, 2013 at approximately 9:45 a.m., possessed a Smith & Wesson .38 Special Revolver loaded with three live rounds with the intent to use it unlawfully at the Chenango Shores Campgrounds in the Town of Greene. It is alleged that Dougher pointed the loaded revolver at another individual while threatening him during a verbal altercation. Furthermore, it is alleged that “believing that certain physical evidence is about to be produced or used in an official proceeding or a prospective official proceeding and intending to prevent such production or use,” Dougher threw the revolver into the Chenango River in an attempt to prevent its recovery. It’s also alleged that he thereafter made a false written statement by swearing to a New York State Trooper that the revolver was a “cap-gun” despite knowing in fact that it was a Smith & Wesson .38 Special Revolver.

• Carrie L. Canfield, 28, Afton, indicted on two counts of second degree robbery, a class C felony.

It is alleged that Canfield, on or about May 9, 2013 at approximately 11:35 a.m. at 207 Corbin Road in the Town of Afton, while acting in concert with others, did forcibly steal U.S. currency along with an iPhone from a victim and while doing so caused that person physical injury. Specifically, the victim was punched and kicked repeatedly in the head and torso, and was also choked resulting in multiple contusions to the torso and left eye orbital area, as well as a fractured sternum. It is also alleged that what appeared to be a firearm was displayed during the course of the alleged robbery.
